Agreement
These Terms of Service ("Terms") are an agreement between you and Ashburn Labs ("we", "us"). They cover your use ofAshburn, including the website at ashburnlabs.com, the iOS app and the services behind them (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and accounts
- You must be at least 18 years old to use Ashburn. By creating an account, you confirm that you are.
- Give accurate information when you sign up, and keep it current.
- An account is for one person. Do not share it or sell access to it.
- Keep your password secure. You are responsible for activity on your account. Tell us at [email protected] if you think someone else has used it.
- You may not use the Service if you are barred from it under the laws of the United States or the country where you live, or if we have previously disabled your account.
Ashburn is in a private beta. New accounts must be approved before they can use the models. We decide which accounts to approve and may limit how many we approve.
The Service
Ashburn gives you access to AI models that we host on our own hardware, and to models from other providers through API keys you connect. Features include chat, file reading, a personal knowledge base, agents, workflows and model comparison.
Each plan has usage limits, such as a number of messages per day and a wait between messages. We show your limits in the app. We add, change and remove features and models over time, and the Service may sometimes be unavailable, slow or interrupted, especially during the beta. We will try to give notice of major changes, but we do not promise that any particular feature or model will stay available.
Your content
You own your content. What you type, upload or add ("Inputs") and what the models produce for you ("Outputs") belong to you, as far as the law allows. We claim no ownership of either.
Permission you give us. You give us permission to store, process, copy, transmit and display your Inputs and Outputs only as needed to run the Service for you. That includes running models, checking content for safety, syncing across your devices, keeping backups, reviewing reports and complying with the law. This permission ends when you delete the content or your account, except for backup copies until they expire.
No training. We do not use your Inputs or Outputs to train AI models.
Your responsibility. You must have the rights to anything you upload or add, and your Inputs must not break the law or these Terms. Other people may receive similar Outputs to yours, and Outputs that match someone else's work are not yours to claim.
AI output
AI models make mistakes. Outputs can be wrong, incomplete, out of date or offensive, and can sound confident when they are wrong. Check anything important before you rely on it.
Outputs are not professional advice. Ashburn is not a doctor, lawyer, financial adviser or other licensed professional. Do not use Outputs as the only basis for decisions about health, safety, legal rights, money or anything else where a mistake could cause harm. You are responsible for how you use Outputs, including following any laws that apply to them.
Acceptable use
Ashburn is built for adults, and within the law you have wide latitude in what you discuss and create. You may not use the Service to:
- Create, request or share sexual content involving minors in any form, including fiction, drawings and AI-generated material. We report it to NCMEC and to law enforcement.
- Get instructions for making weapons capable of mass casualties, including explosives and chemical, biological, radiological or nuclear weapons.
- Get instructions for manufacturing illegal drugs.
- Plan or carry out any other crime, or help someone else do so.
- Threaten, harass, stalk or defame a real person, or create sexual content depicting a real person without their consent.
- Infringe anyone's copyright, trademark, privacy or other rights.
- Create malware, or attack, probe or break into any system you are not authorized to test.
- Interfere with the Service: overload it, get around limits or safety checks, access other users' data, or reverse engineer it except where the law allows.
- Scrape the Service, resell access to it, or use it to build a competing service, without our written permission.
- Pass off Outputs as coming from a human, or impersonate a person or organization, to deceive or defraud someone.
Moderation and enforcement
Every message, reply and uploaded file is checked automatically. Content in the prohibited categories above is blocked, and we record that a block happened. Automated checks are not perfect. They may sometimes block something allowed or miss something that is not, and being missed does not make content allowed.
You can flag any reply. Our staff review reports and blocked activity. If we believe you have broken these Terms, we may remove content, limit features, suspend or disable your account, and report illegal activity to the authorities. Where it is appropriate and lawful, we will tell you what happened. If you think we made a mistake, email [email protected].
Third-party providers
You can connect your own API key for Anthropic, OpenAI or another compatible service. When you use those models, your chats are sent to that provider, its own terms and policies apply, and it bills you directly. You are responsible for following that provider's rules and for any charges on your key. We are not responsible for third-party providers, their models or their outputs. You can remove a key at any time in Settings.
The open-weight models we host are released by their creators under their own licenses.
Plans, payments and subscriptions
Ashburn is free during the beta. We plan to offer paid plans later. Nothing is charged unless you choose a paid plan and confirm the purchase. If you do, these terms apply:
- Price. The price, billing period and what the plan includes are shown before you buy. Prices may include or exclude tax depending on where you live, as shown at checkout.
- Renewal. Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel.
- Cancellation. You can cancel at any time. Your plan stays active until the end of the period you paid for, then returns to the free plan.
- Refunds. Payments are not refundable except where the law requires or where we say otherwise at the time of purchase.
- Price changes. We will notify you before a price change applies to your subscription, and you can cancel before it takes effect.
- Failed payments. If a payment fails, we may move your account to the free plan until it is resolved.
Purchases in the iOS app
Subscriptions bought in the iOS app are sold and billed by Apple through your Apple ID, under Apple's Media Services Terms and Conditions. Payment is charged to your Apple ID at confirmation. Your subscription renews unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel it in your Apple ID's subscription settings. Refund requests for App Store purchases go to Apple.
Purchases on the web
Subscriptions bought on ashburnlabs.com are processed by the payment provider named at checkout. We do not store your full card details. You can manage or cancel a web subscription from your account settings or by emailing [email protected].
Our property
The Service, including its software, design, the Ashburn name and logo, and our modifications to models, belongs to us or our licensors. As long as you follow these Terms, we give you a personal, limited, non-exclusive, non-transferable right to use the Service. You may not copy, sell or modify the Service itself, or use our name or logo without our permission.
If you send us feedback or ideas, we may use them without owing you anything. Feedback does not give us any rights to your Inputs or Outputs.
Ending your account
You can stop using Ashburn at any time. To delete your account and its data, go to Settings, choose Delete account and confirm with your password. Deletion is immediate and cannot be undone. Deleting your account does not cancel an App Store subscription; cancel that with Apple.
We may suspend or close your account if you break these Terms, or if we must do so to comply with the law. We may also stop offering the Service. If we shut down the Service, we will give you reasonable notice so you can copy what you need.
The sections on your content, AI output, our property, disclaimers, limitation of liability, indemnity, and governing law continue to apply after your account ends.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not promise that the Service will be uninterrupted, secure or error-free, that Outputs will be accurate, or that content will never be lost. Some places do not allow these disclaimers, so some of them may not apply to you.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service or these Terms, even if we were told such damages were possible.
Our total liability for any claim about the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US $50.
These limits do not apply where the law does not allow them, such as for liability that cannot be limited for fraud, gross negligence or willful misconduct.
Indemnity
If someone brings a claim against us because of your Inputs, your use of Outputs, or your breach of these Terms or the law, you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees. We will tell you about the claim and let you take part in defending it.
Governing law and disputes
If you have a problem with the Service, email [email protected] first. Most issues can be settled that way. Please give us 30 days to try to resolve it before starting a formal claim.
These Terms are governed by applicable United States federal law and the laws of the state in which Ashburn Labs is organized, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be heard in the state or federal courts where Ashburn Labs is based, and you and we agree to their jurisdiction.
If you are a consumer living outside the United States, you keep any protections the law of your country gives you that cannot be waived by contract, including the right to bring a claim in your local courts.
Apple App Store terms
If you got the Ashburn app from Apple's App Store, these terms also apply. They serve as the license agreement for the app.
- These Terms are between you and Ashburn Labs, not Apple. We, not Apple, are solely responsible for the app and its content.
- You may use the app on Apple-branded devices that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. Family Sharing may also allow use by others in your family group where the app supports it.
- Apple has no obligation to provide maintenance or support for the app. Support questions go to [email protected].
- If the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to conform to a warranty are our responsibility, to the extent these Terms do not exclude them.
- We, not Apple, are responsible for addressing any claims about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If someone claims the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the app, such as your mobile carrier's terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
Questions, complaints or claims about the app go to Ashburn Labs at [email protected].
Changes to these Terms
We may update these Terms as the Service changes. When we do, we will change the effective date above. If a change is significant, we will tell you by email or in the app at least 14 days before it takes effect, unless the change is required by law sooner. If you keep using the Service after a change takes effect, you accept the new Terms. If you do not agree, stop using the Service and delete your account.
General
- These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a part of these Terms right away, we can still enforce it later.
- You may not transfer your rights under these Terms without our consent. We may transfer ours to a company that takes over the Service.
- We are not responsible for delays or failures caused by events outside our reasonable control, such as power or network outages.
- You must follow US export and sanctions laws when you use the Service.
